Synthetic nicotine has been around since 2016, but it’s only in the last year or two that its popularity has begun to rise rapidly. That’s largely due to a major shift in how the federal government is regulating any and all products with ties to tobacco, including e-juices made with tobacco-derived nicotine.

What is Synthetic Nicotine?

In simplest terms, synthetic nicotine is a form of nicotine made in a lab. It is not derived from tobacco and is sometimes called “non-tobacco nicotine.”

What is Synthetic Nicotine Made from?

Synthetic nicotine is made using the exact same chemical structure as traditional nicotine from tobacco: C10H14N2 (10 carbon atoms, 14 hydrogen atoms, and two nitrogen atoms). Scientists are able to create nicotine molecules without any need for tobacco, and the effects are virtually identical to natural nicotine.

The Connection Between the Federal Government and Synthetic Nicotine

In 2009, the federal government passed the Family Smoking Prevention and Tobacco Control Act (also called the Tobacco Control Act). This law puts the FDA in charge of regulating the manufacturing, distribution, and marketing of all tobacco products.

For years, the law was primarily applied to tobacco cigarettes and smokeless tobacco. But then, in early 2020, conversations turned to the vape industry. There were many reports that suggested flavored vape juices would be altogether wiped out, it would be impossible for many vape brands to survive, and vapers would be out of luck. 

Once the smoke and rumors cleared, what really happened was that new regulations were enforced on vape product manufacturers. Referred to as the PMTA regulations, these rules are a complex topic for another day – right now, what you need to know is that they changed the way nicotine e-liquids can be produced and sold. Because tobacco-derived nicotine is now considered a “tobacco product,” it falls under the federally-regulated TPD (Tobacco Products Directive). This means that companies have to jump through many hoops in order to legally sell e-liquids with this form of nicotine.

Enter synthetic nicotine – otherwise known as a legal and effective means for vape brands to comply with the tobacco regulations while producing high-quality, nicotine-infused vape liquids for sale. Because this type of nicotine is not sourced from tobacco, it’s technically free from the TPD.

Is Synthetic Nicotine Regulated by the FDA or Federal Government?

Right now, there are no federal regulations that apply to synthetic nicotine. In the Tobacco Control Act, there’s no mention of non-tobacco products. The Act itself outlined what qualifies as a “tobacco product,” and synthetic nicotine is not included.

So, for now, e-liquid manufacturers can use synthetic nicotine without being subject to complicated regulations and new processes. 

Additionally, the FDA is well-aware of the existence and use of synthetic nicotine. They briefly address it in their FAQs for the regulation of tobacco products, but it is not yet officially an FDA-regulated substance.

Is Synthetic Nicotine a Good Choice for Vaping?

There is essentially no difference between synthetic nicotine and natural, tobacco-derived nicotine. Even on a molecular level, the two are identical. The only way in which they differ is that natural nicotine is derived from the tobacco plant, whereas synthetic is man-made.
