If you’re a fan of JUUL products, then you’ve probably already heard the bad news: in late June, the U.S. Food and Drug Administration (FDA) issued a nationwide vape ban on JUUL e-cig products.
And even though an appeal from JUUL in a federal appeals court was successful in temporarily blocking the ban – and it’s been suspended for the time being – the FDA has said that doesn’t mean that JUUL can sell its products in the interim.

Are JUULs Banned?
Yes. At this time, the JUUL vape device and JUULpods have been pulled off the U.S. market.
Here’s where it gets confusing: if you go to the JUUL website, the brand insists that consumers can still purchase JUUL products. However, the FDA explicitly states that:
“On July 5, 2022, FDA administratively stayed the marketing denial order. The agency has determined that there are scientific issues unique to the JUUL application that warrant additional review. This administrative stay temporarily suspends the marketing denial order during the additional review but does not rescind it. All electronic nicotine delivery systems, or ENDS products, including those made by JUUL, are required by law to have FDA authorization to be legally marketed. The stay and the agency’s review does not constitute authorization to market, sell, or ship JUUL products.”
This statement makes it pretty clear for reputable vape retailers: selling JUULs is a no-go.
Why Did JUUL Get Banned?
Recently, the FDA has implemented regulatory measures requiring vape companies to show how their products benefit public health.
In other words, our favorite brands need to prove that their vapes, e-juices, and other products help adult cigarette smokers stop or reduce their smoking. The companies also need to demonstrate the minimal risk that underage vapers (teens) will become addicted to nicotine via their products.
Unfortunately, the application submitted by the JUUL brand was said to come up short. Regulators stated that they had extensive questions about the potential health risks of JUULs, so they denied the application (a process referred to as a “marketing denial order,” or MDO). As a result, JUUL was no longer allowed to sell, market, or ship its products to U.S. consumers.
For the record, JUUL issued a statement arguing that they provided excellent evidence – but in this case, the FDA will likely get the last word.
Almost immediately, the FDA’s ban was challenged by the U.S. Court of Appeals. On July 5, 2022, the FDA announced a “stay” on the ban. However, they clearly said that the stay did not mean that JUULs were back on the market. Instead, they’re going to review further to make a final decision.
JUULs are Banned: What Now?
If you’re a JUUL enthusiast, the FDA ban has probably left you with more questions than answers. We’re going to tell you what we know, based on the information provided by the FDA itself – so you can be confident these details are accurate.
Which JUUL products are banned?
Many vapers are confused about exactly which JUULs are banned. Unfortunately, even though only four types of JUULpods were included in the ban, the JUUL device is also a target. So, even if you can find any “legal” JUULpods, you can’t buy a device to use them with.

Can you still use JUULs?
So, are you allowed to use JUULs? If you already have a JUUL device and a stockpile of pods, you can keep using them. The FDA’s ruling doesn’t apply to consumers, just commercial sales.
